1. Introduction

These Terms and Conditions (“Terms”) govern your use of the skip hire services provided by Andrew Hardings trading as Hardings Valley Skips (“we”, “us”, “our”), a sole trader registered in England.

By placing an order through our website or by telephone, you (“the Customer”) agree to be bound by these Terms. Please read them carefully before booking.

2. Services

We provide domestic and commercial skip hire services within our designated service area. Skip sizes available for online booking are:

– 4 Yard Skip
– 8 Yard Skip

Other skip sizes and waste management services may be available by contacting us directly.

3. Service Area

We operate within specific postcode areas in Lancashire and the surrounding region. Our website includes a postcode checker to confirm whether we deliver to your location.

If an order is placed for a postcode outside our service area (for example, due to a system error), we reserve the right to cancel the order and issue a full refund.

4. Booking and Payment

4.1 Placing an Order

Orders can be placed through our website. You will select your skip size, delivery date, time slot (AM or PM), and delivery location. Delivery availability is shown via our online calendar and is subject to demand.

4.2 Payment

Full payment is required at the time of booking. We accept payment via our secure online payment gateway. All prices shown on our website are inclusive of VAT where applicable.

Road permit fees, if required, are charged separately and will be added to your order at checkout.

4.3 Order Confirmation

Once your order is placed and payment is received, you will receive an email confirmation. This confirmation constitutes a binding contract between you and Hardings Valley Skips.

5. Delivery

5.1 Delivery Slots

We offer AM and PM delivery slots. Same-day and next-day delivery may be available depending on capacity, as shown on our booking calendar.

5.2 Delivery Location

You are responsible for ensuring that:

– The delivery location is accessible for our vehicles.
– There is adequate space for the skip to be placed safely.
– The ground is suitable to support the weight of the skip and its contents.
– Any gates, barriers, or obstructions are removed or opened prior to delivery.

If the skip is to be placed on private land, you must have the landowner’s permission.

5.3 Road Permits

If the skip is to be placed on a public highway (including roads, pavements, or grass verges), a road permit is required by law. We can arrange this permit on your behalf for an additional fee, which will be shown at checkout.

**Important:** Road permits require a minimum of 5 working days’ notice. If you require a permit, please ensure you book with sufficient lead time. Orders requiring a permit with less than 5 working days’ notice may be subject to delay or cancellation.

5.4 Failed Deliveries

If our driver arrives and is unable to place the skip due to:

– Blocked or inadequate access
– Unsafe placement conditions
– A road permit not being in place when one is required
– Any other reason caused by the Customer

A failed delivery charge of **£80** will apply. We will contact you to arrange an alternative delivery, subject to availability and further payment if applicable.

6. Hire Period

6.1 Standard Hire Period

The standard hire period is **14 days** from the date of delivery.

6.2 Extensions

If you require the skip for longer than 14 days, please contact us as soon as possible. Extensions may be granted at our sole discretion and are not guaranteed. We may allow a short extension of 1–2 days where operationally feasible, but this should not be assumed.

6.3 Early Collection

If you require collection before the end of your hire period, please contact us to arrange this. Early collection is subject to availability.

7. Cancellations and Refunds

7.1 Cancellation by the Customer (Before Delivery)

You may cancel your order before delivery. The refund you receive depends on how much notice you provide:

**Important:**

– All cancellation requests must be made **in writing** via email to enquiries@hardingsvalleyskips.co.uk. The timestamp of the email will be used to determine the notice period.
– **We do not accept cancellations by voicemail.** Voicemail messages will not be treated as valid cancellation requests.
– Where no refund is due, rescheduling may be possible but is not guaranteed and is subject to availability.

7.2 Cancellation After Delivery

Once the skip has been delivered, no refunds will be given. You will be liable for the full cost of the hire.

7.3 Cancellation by Us

We reserve the right to cancel an order at any time if:

– The delivery postcode is outside our service area.
– We are unable to deliver due to circumstances beyond our control (e.g., severe weather, vehicle breakdown, road closures).
– We have reasonable grounds to believe the skip will be used in breach of these Terms.

If we cancel your order, you will receive a full refund.

8. Prohibited Items

The following items **must not** be placed in our skips under any circumstances:

1. Asbestos or asbestos-containing materials
2. Tyres
3. Fridges, freezers, and electrical items (WEEE)
4. Gas bottles or pressurised containers
5. Batteries (car or industrial)
6. Clinical or medical waste
7. Hazardous chemicals, solvents, or paints

If prohibited items are found in your skip, we reserve the right to:

– Refuse collection until the items are removed.
– Remove the items and charge you for the cost of their safe disposal.
– Report the matter to the relevant authorities if required by law.

**You are responsible for ensuring that no prohibited items are placed in the skip.**

9. Restricted Items

The following items may be placed in skips but **must not exceed 50%** of the skip’s total capacity:

– Carpets and carpet tiles
– Playground rubber
– Artificial grass

If a skip is found to contain more than 50% of any restricted item, we reserve the right to refuse collection or apply additional charges to cover disposal costs.

10. Overfilled Skips

Skips must not be filled above the fill line (the top edges of the skip). This is a legal requirement for safe transportation on public roads.

While we do not charge extra for overfilled skips, **we reserve the right to refuse collection** until the load is reduced to a safe and legal level. Any delays caused by overfilling are your responsibility.

11. Your Responsibilities

As the Customer, you agree to:

– Provide accurate information when booking, including correct delivery address and contact details.
– Ensure the delivery location is accessible, safe, and suitable for skip placement.
– Obtain any necessary permissions from landowners for skip placement on private land.
– Not move the skip once it has been placed.
– Not place prohibited items in the skip.
– Not exceed the restricted item limits.
– Not overfill the skip above the fill line.
– Keep the skip and its contents secure during the hire period.
– Ensure that any skip placed on the highway is properly lit at night (we may provide lights or cones, but you are responsible for maintaining them).

12. Our Liability

12.1 Our Responsibility

We will deliver and collect your skip with reasonable care and skill. We hold public liability insurance to cover damage caused by our negligence.

12.2 Limitations

We are not liable for:

– Any damage caused by items placed in the skip by you or third parties.
– Any loss or damage arising from your failure to comply with these Terms.
– Damage to surfaces (driveways, paving, lawns, etc.) caused by the weight of the skip, unless due to our negligence.
– Delays or failures caused by circumstances beyond our reasonable control.

12.3 Your Liability

You are responsible for any damage, fines, or third-party claims arising from your use of the skip, including (but not limited to):

– Damage to property caused by items placed in or around the skip.
– Fines for placing a skip on the highway without a valid permit.
– Claims from third parties for injury or damage connected to the skip during the hire period.

14. Changes to These Terms

We may update these Terms from time to time. The version in effect at the time of your booking will apply to your order.

15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
